- Scope of application and definitions
1.1 Love Green Hotels UG (haftungsbeschränkt) (hereinafter referred to as Love Green Hotels) operates an online marketplace that provides information about sustainably managed accommodation options via a website.
1.2 The General Terms and Conditions of Business and Use of Love Green Hotels apply exclusively.
Deviating, conflicting or supplementary General Terms and Conditions of Business and/or Terms of Use of a user, accommodation provider and/or visitor shall not become part of the contract unless Love Green Hotels has expressly agreed to their validity in writing. This requirement of consent shall apply in any case, for example even if Love Green Hotels performs its services in full knowledge of the General Terms and Conditions and/or Terms of Use of a user. Unless expressly stated otherwise, the following General Terms and Conditions of Business and Use apply to all uses of the platform.
1.3 Love Green Hotels is entitled to unilaterally amend these General Terms and Conditions of Business and Use with effect for the future, insofar as this is necessary to eliminate subsequent equivalence disturbances or to adapt to changed legal or technical conditions. Love Green Hotels will inform accommodation providers of any changes. The change shall become effective if the accommodation provider does not object to Love Green Hotels in writing or text form within two weeks of receipt of the notification of change. If the accommodation provider objects, both parties have the right to terminate the relevant agreement with immediate effect. Otherwise, the General Terms and Conditions of Business and Use applicable up to that point shall continue to apply.
1.4 "User" within the meaning of these terms and conditions is any natural or legal person who accesses the platform for the purpose of obtaining information.
1.5 "Accommodation provider" is any natural or legal person who registers to make his/her accommodation(s) findable via the Love Green Hotels website.
1.6 "Visitor" is any natural or legal person who visits the platform to obtain information and find accommodation.
1.7 "Registered visitor" is any natural or legal person who registers at
in order to mark accommodation for themselves, enter comments and ratings in the comments function and communicate with accommodation providers via the Love Green Hotels website.
- Services from Love Green Hotels
2.1 Love Green Hotels offers an online platform that allows interested users, accommodation providers, visitors and registered visitors to use the marketplace for sustainable accommodation free of charge in the form of simply obtaining information via a website.
By using the website, the interested user, accommodation provider, visitor and/or registered visitor accepts the General Terms and Conditions of Business and Use in the version current at the time of use.
2.2 An accommodation provider has the option of registering as an accommodation provider free of charge. By registering, the accommodation provider accepts the General Terms and Conditions of Business and Use in their entirety.
2.3 The registered accommodation provider has the option of creating one (or more) accommodation profiles on which he/she presents his/her accommodation(s) (see §3).
2.4 A visitor has the option of registering as a visitor free of charge. By registering, the user accepts the General Terms and Conditions of Business and Use in their entirety.
2.5 An unregistered or registered visitor has the option of contacting an accommodation provider registered on Love Green Hotels using information provided by the accommodation provider.
2.6 Love Green Hotels only offers the interested accommodation provider and the visitor the opportunity to conclude an agreement with each other via its platform. Consequently, Love Green Hotels itself is not a party to any agreement that may be concluded between the interested accommodation provider and a visitor.
2.7 The use of the marketplace as a visitor and also as a registered visitor is free of charge, i.e. Love Green Hotels does not charge a fee for this.
2.8 The registration of accommodation profiles of the accommodation provider is subject to a fee (see § 7).
2.9 The services offered by Love Green Hotels do not include ensuring the necessary use of the Internet. The user is responsible for Internet access, the technical requirements, the configuration and performance of the end device for using the application and the up-to-dateness of the required software at his/her own expense.
2.10. There is no entitlement to constant and uninterrupted availability of the services offered by Love Green Hotels. However, Love Green Hotels endeavors to achieve the highest possible availability and to rectify disruptions as quickly as possible. Love Green Hotels is entitled to temporarily or permanently suspend the provision of options and content in whole or in part.
2.11. Love Green Hotels is continuously developing the platform. In this respect, Love Green Hotels reserves the right to adapt, improve, supplement or add additional functions to the respective functions of the platform.
2.12. Love Green Hotels does not owe any services beyond those specified in § 2. In particular, Love Green Hotels is not obliged to provide installation, furnishing, customization or consulting services.
2.13. Love Green Hotels may use subcontractors to fulfill its services.
- Registration and requirements for creating an accommodation profile
3.1 Registration as an accommodation provider takes place via the registration form on the website. Registration constitutes a corresponding offer to Love Green Hotels to create and use an accommodation provider profile.
3.2 The agreement is concluded when the accommodation provider receives the declaration of acceptance in the form of the opening of his/her accommodation provider profile from Love Green Hotels after submitting the registration form. However, there is no legal claim to the conclusion of an agreement, i.e. Love Green Hotels reserves the right in any case to reject the accommodation provider's offer to create and use an accommodation provider profile without giving reasons.
3.3 The accommodation provider shall create one or more accommodation profiles on his/her accommodation provider profile in accordance with the accommodation form.
3.4 Based on the personal information provided by the accommodation provider to Love Green Hotels via the accommodation form, Love Green Hotels will create an accommodation profile for use on the website.
3.5 The accommodation provider guarantees to provide truthful, up-to-date and complete information as specified in the accommodation form and to inform Love Green Hotels immediately of any changes. In addition to an existing e-mail address, the accommodation provider must provide: his/her postal address, a billing address, a responsible contact person, his/her telephone number and the number of employees per accommodation.
Each accommodation provider may only have one active accommodation provider profile.
Consequently, Love Green Hotels reserves the right to deny the accommodation provider the use of an accommodation provider and/or accommodation profile if he/she provides incorrect, incomplete or outdated information or if, in the opinion of Love Green Hotels , he/she does not intend to create and publish accommodation profiles in the foreseeable future.
3.6 The Proprietor is responsible for ensuring that his/her registration data is not disclosed to third parties. The accommodation provider shall inform Love Green Hotels immediately upon becoming aware of any unauthorized use of his/her accommodation provider profile and/or accommodation profiles.
- General obligations
4.1 Users, accommodation providers and visitors undertake to refrain from actions that could impair the functionality of the service. Areas of the website not made available for this purpose may not be modified, reproduced or distributed unless these General Terms and Conditions of Business and Use expressly grant this right.
4.2 Users, accommodation providers and visitors undertake to use the online marketplace in such a way that no impairments or damage occur to it and that the purpose pursued with the application can neither be jeopardized nor circumvented. Any existing safety precautions may not be circumvented or altered.
4.3 The registered user or accommodation provider undertakes to use the access password for the profile only himself/herself and not to pass it on to third parties.
4.4.. The registered user or accommodation provider is responsible for ensuring that his/her
registration data is not disclosed to third parties. The user or accommodation provider shall inform Love Green Hotels immediately upon becoming aware of any unauthorized
use of his/her user, accommodation provider profile and/or
accommodation profiles.
4.5 The technology provided by Love Green Hotels may not be copied, modified, reverse engineered, decompiled or distributed, unless this is permitted by mandatory legal provisions.
4.6 The technology of Love Green Hotels or any of its content may not be illegally imitated, sold, rented or used or offered for own or third-party advertising purposes outside the Love Green Hotels platformand in particular not for commercial purposes.
4.7 Users, accommodation providers and visitors acknowledge that all rights to the technology, in particular copyrights and industrial property rights, are the sole property of Love Green Hotels . They will therefore only use such rights if Love Green Hotels has demonstrably granted them the corresponding rights of use.
- Responsibility, prohibited content and conduct
5.1 Registered users and accommodation providers are responsible for all activities carried out via their profile and for all content published under their participant name. Love Green Hotels will be informed immediately of any misuse of the Love Green Hotels profile.
5.2 The registered user or accommodation provider undertakes not to publish any unlawful content on the Love Green Hotels online platform. Unlawful content includes in particular
- Racist, pornographic, obscene, offensive, vulgar, violence-glorifying or trivializing as well as immoral content;
- Content that may encourage others to commit criminal acts;
- Content that impairs or endangers the development or upbringing of children or young people or violates human dignity or other protected legal interests;
- Insulting or offensive statements/representations as well as threats against other participants, providers or third parties;
- Abusive criticism, defamation and content that may violate the right to informational self-determination of third parties;
- copied content to which you have no rights;
- Links to websites with content that violates applicable law or is harmful to minors;
- Unauthorized advertising on your own behalf, e.g. competitions, discount campaigns or special sales as an event;
- private data, such as telephone number, address or e-mail address outside the profile.
5.3 If criminal offenses are suspected, the competent authorities will be informed, the data secured and the respective content taken offline.
5.4 Registered users and accommodation providers are themselves responsible for all information and other content created by them. He/she assures that the information and other content created by him/her does not violate these General Terms and Conditions of Business and Use or the rights of third parties and statutory provisions.
5.5 Love Green Hotels reserves the right to delete or reject content. This applies in particular to content that appears to be unlawful and content that has been brought to Love Green Hotels ' attention by third parties as part of regular checks.
- Rights of use
6.1 Users, accommodation providers and visitors have the right to obtain information about all content published on the Love Green Hotels platform while using the platform. The user is not permitted to dispose of the content available on the platform, in particular to reproduce, distribute, publish, edit or modify it.
6.2 The information about content and participants obtained within the scope of the aforementioned permitted use may only be used within the scope of the permitted use.
6.3 Love Green Hotels grants the registered visitor or accommodation provider the rights required to create content using the technology provided by Love Green Hotels for this purpose in the registered area of the platform. This also includes the right to distribute the content created by the accommodation provider on the Love Green Hotels platform.
6.4 A registered visitor or accommodation provider may not grant any third party the right to use the technology without the consent of Love Green Hotels .
6.5 By posting content on the online marketplace, the registered visitor or accommodation provider grants Love Green Hotels the exclusive right, unlimited in time and space, to reproduce, distribute, make publicly accessible, edit and make available for retrieval on the online marketplace (online, access and transmission right) the content created by the registered visitor or accommodation provider in order to fulfill the services of Love Green Hotels .
6.6 Any use other than that permitted by Love Green Hotels and the registered visitor or the accommodation provider or by law is not permitted unless Love Green Hotels or the registered visitor or the accommodation provider has expressly and verifiably authorized this.
- Term, premium amount, payment, termination, termination
7.1 The contractual relationship between Love Green Hotels and the accommodation provider is established for one year with the publication of the accommodation profile by the accommodation provider.
The contractual relationship can be terminated by both Love Green Hotels and the accommodation provider in writing or text form in accordance with the right of withdrawal (see § 8) within fourteen days without giving reasons. The right to terminate for good cause remains unaffected by this.
7.2 Accommodation providers pay Love Green Hotels the annual amount for each individual accommodation location (location address), which is shown in a profile on the Love Green Hotels website.
The respective basic amount is net and is staggered according to the number of employees per accommodation (except vacation apartments and houses):
0-3 employees: 160 Euro/year
4-10 employees: 300 Euro/year
per 10 employees more: plus 300 Euro/year, e.g. 11-20 employees: 600 Euro/year etc.
Holiday apartments and houses: 80 Euro/year
Until 30.04.2025 the basic amount for all types of accommodation is 0 Euro/year.
7.3 The annual fee is due after publication of the accommodation profile on the Love Green Hotels website by the accommodation provider.
7.4 Payment of the annual fee shall be made on account and must be paid within ten days of receipt of the invoice without deduction. In the event of late payment, Love Green Hotels is entitled to withdraw the publication of the accommodation provider's profile on its website.
7.5 The visibility of the accommodation profile remains for one year and is not automatically extended.
An extension for a further year is possible if the accommodation provider wishes to pay a further annual fee.
7.6 In addition, Love Green Hotels expects the accommodation provider to use 10% of all income received from visitors to Love Green Hotels for nature conservation, resource-saving and CO2-reducing measures at their accommodation or at the location of the accommodation.
7.7 In addition, Love Green Hotels is entitled to deny a user, accommodation provider and/or visitor the use of the Love Green Hotels online marketplace in whole or in part with immediate effect in the event of legal violations by a user, accommodation provider and/or visitor on the basis of these General Terms and Conditions of Business and Use and/or relevant statutory provisions.
- Right of withdrawal
8.1 The Proprietor has the right to withdraw from his/her contract with Love Green Hotels within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract. In order to exercise his/her right of withdrawal, the Proprietor must notify the

by means of a clear statement (e.g. a letter sent by post or e-mail) of his/her decision to withdraw from this contract. In order to comply with the withdrawal period, it is sufficient for the accommodation provider to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
8.2 Consequences of withdrawal: If the accommodation provider withdraws from this contract, Love Green Hotels must refund all payments that Love Green Hotels has received from him/her immediately and at the latest within fourteen days from the day on which Love Green Hotels receives notification of his/her withdrawal from this contract.
For this repayment, Love Green Hotels will use the same means of payment that the accommodation provider used for the original transaction, unless expressly agreed otherwise with the accommodation provider; under no circumstances will the accommodation provider be charged any fees for this repayment.
If the accommodation provider has requested that the services begin during the withdrawal period, he/she must pay Love Green Hotels a reasonable amount corresponding to the proportion of the services already provided up to the time at which he/she informs Love Green Hotels of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.
- Data protection
9.1 Love Green Hotels ensures that the personal data of users of its services is handled lawfully at all times. In addition, the declarations on data protection apply, which can be found in a separate data protection declaration.
9.2 The collection, processing and use of users' personal data must only take place for the purpose of the intended and lawful use of the services offered by Love Green Hotels.
10. liability
10.1 Love Green Hotels is not liable for the error-free and/or constant availability of web-based services, nor for technical and electronic errors. In particular, Love Green Hotels is not liable for the error-free functioning of end devices of the parties involved. Nor is Love Green Hotels liable for the performance and constant availability of a communication network used by the user, accommodation provider or visitor.
Consequently, Love Green Hotels accepts no liability for delays in the transmission of data due to disruptions in third-party networks. Likewise, Love Green Hotels is not liable for the temporary or permanent interruption of data transmission to the user.
10.2 Love Green Hotels accepts no liability for any loss of data for which Love Green Hotels is not responsible. Users, accommodation providers and visitors are responsible for backing up their own data.
10.3 Love Green Hotels is liable for contractual claims or non-contractual claims only for damages resulting from willful or grossly negligent acts and for damages resulting from slightly negligent breaches of cardinal obligations. In the latter case, liability is limited to the typical contractual damage foreseeable at the time the contract was concluded.
However, the limitations of liability shall not apply in the event of injury to life, limb or health, in the scope of application of the Product Liability Act and in the event of the assumption of express guarantees and in cases where statutory regulations prescribe mandatory liability.
10.4 Insofar as Love Green Hotels is liable for data loss, this is limited to the typical recovery costs. This is measured according to the damage that would have occurred if reasonable backup measures had been taken (e.g. making backup copies).
10.5 Love Green Hotels accepts no liability for damages resulting from the business activities of third parties.
10.6 Insofar as the liability of Love Green Hotels is excluded or limited in accordance with the above provisions, this also applies to the liability of Love Green Hotels' employees, representatives and vicarious agents.
11. warranty
11.1 Love Green Hotels is liable for defects in accordance with the statutory provisions.
12. liability for content
12.1 The registered visitor or accommodation provider is solely responsible for content that an accommodation provider makes available or saves. Love Green Hotels merely provides a platform for content.
If Love Green Hotels becomes aware that third-party content violates statutory provisions or the rights of third parties, Love Green Hotels will take appropriate measures, subject to verification of whether the allegation of illegality is justified. In the event that third parties assert claims against Love Green Hotels due to the content of a registered visitor or accommodation provider, the registered visitor or accommodation provider undertakes to inform Love Green Hotels immediately, truthfully and in full of the facts on which the claims are based. In the event that the claims are justified, the registered visitor or accommodation provider undertakes to indemnify Love Green Hotels against such claims and to compensate Love Green Hotels for any resulting damages. The assertion of further rights and claims for damages by Love Green Hotels remain unaffected. The registered visitor or accommodation provider has the right to prove that Love Green Hotels actually incurred lower costs.
12.2 The registered visitor or accommodation provider assures Love Green Hotels that he/she holds all rights (in particular copyrights and personal rights, industrial property rights, etc.) to the content created and transmitted by him/her, and in particular that he/she is entitled to transfer the corresponding rights of use to Love Green Hotels .
12.3 Insofar as Love Green Hotels is a service provider within the meaning of Section 7 (1) TMG, Love Green Hotels is responsible for its own content on its website in accordance with general laws. However, Love Green Hotels is not obliged under §§ 8 to 10 TMG to monitor transmitted or stored third-party information or to investigate circumstances that indicate illegal activity. Obligations to remove or block the use of information in accordance with general legislation remain unaffected by this. However, an attitude in this respect is only possible from the time of knowledge of a specific infringement.
If Love Green Hotels becomes aware of any such legal infringements , Love Green Hotels will, subject to verification of whether the allegation of illegality is justified, remove this content immediately and reserve the right to temporarily or permanently prohibit the accommodation provider from using the services offered by Love Green Hotels .
12.4 Insofar as the offers of Love Green Hotels contain links to external websites of third parties over whose content Love Green Hotels has no influence, Love Green Hotels cannot accept any liability for this third-party content, even insofar as the respective provider or operator of the pages is always responsible for the content of the linked pages. Irrespective of the fact that Love Green Hotels cannot reasonably be expected to permanently monitor the linked content, Love Green Hotels will check the content at regular intervals on a random basis. If Love Green Hotels becomes aware of any legal infringements, Love Green Hotels will immediately remove such links, subject to verification of whether the allegation of illegality is justified, and reserves the right to temporarily or permanently prohibit the customer from using the service(s) offered by Love Green Hotels .
13 Place of jurisdiction, applicable law
13.1 German law shall apply to the contractual partners for all legal relationships arising from a contractual relationship. German law shall also apply to cross-border transactions to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
13.2 Insofar as the customer is a merchant, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from or in connection with this contract shall be Hamburg.
14. severability clause
14.1 Should individual provisions of these GTC be invalid or unenforceable or become invalid or unenforceable after conclusion of the contract, this shall not affect the validity of the remainder of the contract. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic objective pursued by the contracting parties with the invalid or unenforceable provision.
14.2 The above provisions shall also apply in the event that the contract or the GTC prove to be incomplete.
